Common Questions
Florida requires subcontractors and materialmen who do not have a direct contract with the property owner to serve a Notice to Owner within 45 days of first furnishing labor or materials. Without this notice, the subcontractor has no lien rights regardless of how much money is owed.
Florida provides statutory forms as a safe harbor but does not mandate their use. However, a party cannot require you to use a non-statutory form. The statutory form protects all parties.
